Terms

Terms of Business

Review, external provision, payment and liability, set out in full.

What Is Governed

Three things fall under these terms: requests submitted through chicagocmmcalibration.com, the quotations issued in response to them, and the performance of CMM Calibration and Repair and related work arranged through this site. Acceptance is by conduct — submitting a request, or accepting a quotation issued in response to one. A signed supply agreement or agreed purchase-order terms already in place take precedence over these terms, to the extent of any conflict.

Review of Requests, Tenders and Contracts

A review precedes every quotation. It confirms that the requirement has been stated clearly and is understood, that the method, range and measurement capability needed are on hand, and that the laboratory selected to carry out the work is competent to perform it.

Where a statement of conformity is required, the decision rule to be applied and the specification the item is assessed against are both agreed in writing before work begins. A requirement that changes after acceptance is confirmed to the customer before work continues, with the review repeated. A request that cannot be met as specified is declined, or returned with an alternative scope — it is never quietly reduced and accepted as though nothing changed.

External Providers and Payment

Technical work described on this site is externally provided. The position of the operator is stated exactly: CMM Calibration and Repair Chicago operates chicagocmmcalibration.com as a marketing and referral website, it is not itself a calibration laboratory, and it does not perform the measurements described here. External laboratories receive the requests, and each holds its own accreditation, operates its own quality management system, and issues its own certificates and reports.

Criteria for selecting one of them are stated, not left to preference: current accreditation and the scope of it, demonstrated capability for the specific measurement requested, traceability arrangements, and record of on-time delivery. Performance is monitored on an ongoing basis and a provider that ceases to meet the criteria is not used. Any instruction from a customer that work must not be subcontracted is honored, failing which the request is declined.

In connection with that introduction the operator of this website is paid, whether as a referral fee, a fixed fee for the use of this website, or a commission on work that is placed. The commercial relationship behind the site is set out here, not left implicit. The price quoted is unaffected, and the payment gives the operator no role in performing, approving or certifying any measurement.

How Quotations Work

Each quotation is issued in writing and stays valid for thirty (30) days from the date of issue, unless it states otherwise. What goes into it is the item description, the quantity, the measurement points, the tolerances, and the turnaround given with the request.

If the item on arrival is not the item described — extra channels, a wider range, damage, or a condition that needs repair before measurement can happen — the work pauses for a revised quotation, and resumes only once that revision is approved in writing.

Turnaround Times

Turnaround appears on the quotation in business days, and the clock starts on receipt of the item or receipt of written approval to proceed, whichever is later. Where capacity allows, expedited handling is available, quoted separately. Commitments are made in good faith against current capacity, and where one cannot be met, notice follows as soon as the delay is known — with a revised date.

Items, Handling and Risk

Packaging adequate for transit, plus any accessories, fixtures, cables or software needed to complete the work, travels with the item. Carriage not arranged and charged on the quotation leaves transit risk, in both directions, with the customer.

An item that is unsafe, contaminated, or outside the condition accepted at review goes back unworked, with the reason stated. Once the collection or despatch period agreed on the quotation passes, a completed item sits at the customer's risk.

Payment Terms

Where no credit account has been approved in advance, payment in full comes before certificates and items are released. Approved credit terms instead make invoices payable net thirty (30) days from the date of invoice.

The quoted price excludes taxes, duties and carriage unless the quotation says otherwise. Overdue balances may carry interest at the lower of one and one-half percent (1.5%) per month or the maximum permitted by law, and work in progress may be suspended while an account is overdue.

Certificates, Reports and Their Use

Issue of a certificate or report is by the laboratory that performed the work, and the document remains that laboratory's technical record. Once payment has been made in full, the customer holds an unrestricted right to keep, copy and use the certificate for its own quality, audit and regulatory purposes.

The certificate is issued as a complete document. It may be reproduced only in full, and partial reproduction requires written approval. The performing laboratory retains copies for the period its records policy sets, and will reissue against the original certificate number.

Confidentiality Obligations

Whatever is obtained or created in the course of a request is held in confidence. That includes drawings, specifications, tolerances, measurement results, and the fact that the engagement exists at all. Personnel and providers who need the information to complete the work receive it; so does a body to which the law requires disclosure, and an accreditation body exercising its rights of access. The customer is notified of a legally required disclosure unless the notification is itself prohibited.

Limits of Liability

The work is performed with reasonable skill and care and in accordance with the methods and standards stated on the quotation and on the resulting certificate. Where it is shown to be defective, re-performance of the affected work or a refund of the amount paid for it is the remedy, at the customer's election.

Total liability arising out of any engagement is limited to the amount paid for the work giving rise to the claim, to the maximum extent permitted by law. Liability does not extend to loss of profit, loss of production, loss of contract, or any indirect or consequential loss. Liability that cannot be limited by law is not limited here.

Governing Law

These terms are governed by the laws of Illinois, without regard to conflict-of-law principles, and any claim is brought in the courts of that jurisdiction unless a different forum has been agreed in writing.

These terms may be revised. The version published at chicagocmmcalibration.com on the date a quotation is issued is the version that applies to that engagement. Related terms are set out in the privacy policy, the disclaimer notice and the complaints policy.
